COVID-19 Assumption of Risk, Waiver of Liability & Indemnity Agreement

 I understand that (a) coronavirus/COVID-19, has been declared a worldwide pandemic by the World Health Organization, (b) COVID-19 is contagious and is believed to spread mainly from person-to-person contact and (c) as a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.  I also understand that Casa Mannabliss (hereinafter referred to as “CasaMB”) cannot guarantee that I and/or my child(ren) will not become infected with COVID-19 as a result of participation in CasaMB classes, workshops or events or as a result of using CasaMB facilities for any reason whatsoever as a student or a teacher.   I further understand that attending and/or facilitating CasaMB classes, workshops and/or events or use of CasaMB facilities for any purpose whatsoever may increase my risk and my child(ren)’s risk of exposure to and/or contracting COVID-19 and I fully assume such risk for myself and any of my children.  I have read and agreed to participate at my own risk.  I understand that CasaMB is not mandating masks or social distancing nor is it limiting the number of students participating, but rather, is encouraging each person to take personal responsibility and create their own truths or boundaries around this disease.  The risk for contracting COVID is significantly increased when attending live events. For those preferring to socially distance, CasaMB offers online classes and for those who have vaccinated or feel safe in social settings, we offer live classes.  I understand CasaMB’s stance on COVID-19 is as follows:  CasaMB feels that each person should take personal responsibility to do what is right for ourselves and our families and we believe and support that we each individually have the right to take on as much or little risk for exposure to COVID-19 as we are comfortable with.  For students who are uncomfortable with close contact inside of our yoga studios, CasaMB offers on-line classes via zoom (and video upon request). For students choosing to come to the studio, such students should do so in full awareness that CasaMB is  not mandating any distances or masks and at their own risk. CasaMB, however, does encourage students to be respectful of others.  Our teachers will not police distances or masks or temperatures, nor will CasaMB set any criteria on what is right or wrong as CasaMB believes that each person has the right to and capacity to make that decision for themselves and act in accordance to what is right for them.  We also trust our students to make the best decisions for their highest good and the highest good of our community. Once again, CasaMB is offering online options for folks uncomfortable with our open policy or with being near people.  We also ask students to stay home if you have any condition that puts you at higher risk for contracting COVID-19.  At CasaMB it is mandatory that students or teachers stay home for 14 days from the date they discover they have any symptom that could be indication of COVID-19 or if they have traveled to any high risk area or been in contact with an infected person.  And if any person that has been in the studio suspects they had COVID-19 at the time they were in the studio, we ask that you report it via email to  

User acknowledges the contagious nature of COVID-19 and voluntarily and solely assumes any and all risk of exposure or infection if that he/she or his/her child(ren) attend any live CasaMB service and such assumption of liability and risk shall include  personal injury, illness, permanent disability, and/or death. I understand that the risk of becoming exposed to or infected by COVID-19 at CasaMB may result from the actions, omissions, or negligence of myself and others, including, but not limited to, CasaMB directors, officers, members, employees, teachers, contractors, volunteers and other program participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself including, but not limited to, personal injury, disability, death, illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s exposure to or contracting COVID-19 from participation in CasaMB programming or use of CasaMB facilities.

User hereby knowingly, voluntarily,  irrevocably and expressly waive, release, indemnify, covenant not to sue, discharge, and hold harmless CasaMB, its employees, contractors, agents, teachers, representatives, members, officers, directors, students, successors and assignees, of and from any and all claims, liabilities, demands, actions, damages, costs or expenses of any kind arising out of or relating to user or his/her children contracting COVID-19 as a result of facilitating or attending CasaMB classes, workshops, or events or using CasaMB premises, services or products in any manner whatsoever.  User understands and agrees that this waiver and release of liability includes, but is not limited to, any claims based on the actions, omissions, or negligence of CasaMB, its employees, teachers, contractors, members, officers, directors, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any CasaMB program.

User additionally agrees that he/she will not attend any classes, workshops or events or use the CasaMB facility in any manner whatsoever if any of the following symptoms are present:  fever or chills, cough, shortness of breath or difficulty breathing, fatigue, muscle or body aches, headache, new loss of taste or smell, sore throat, congestion or runny nose, nausea or vomiting, and/or diarrhea.  All students and teachers are also asked to stay home for 14 days (a) post travel or contact with any person who has traveled to a location that is high risk of coronavirus or (b) if they or a person they have had contact with has or suspects they have coronavirus.

User agrees that he/she will inform CasaMB immediately by email to if he/she is diagnosed or suspect to have contracted or have been exposed to COVID-19 if such user has been at the CasaMB facility within 2 weeks of such event.  I understand that CasaMB will trace and notify students exposed to COVID-19, when Casamb becomes aware that any 2 or more students in any given class have contracted COVID-19.

User has read the above and agrees to the CAsamb COVID-19 policy.
